Fwg the thread on this, U.S. builders might consider that FAA has been
getting out of the inspection business, expanding the DAR program
(Designated Airworthiness Representative) nationwide.  Previously,
these guys were mostly ex-FAA, growing up in a world where neither the
employee nor the gov't can be practically sued.  Inspections thus
haven't been a big problem, including by DARs.  But a consequence of
greatly expanding the program may be newly-minted DAR's from other
walks of life raising the personal liability issue.

While DAR's are acting on behalf of the FAA, which might provide some
shield, it's possible the framework will never go beyond the general
legal principle that this is OK as long as the DAR acts prudently
"within scope," that is, consistent with FAA guidance defining
airworthiness.  That has potential for future inspections becoming
very strict.  Hopefully it won't include concern over nonaircraft
hardware in trivial areas, but for critical systems, if the book says
12" spacing on fuel line clamps, maybe they should be.  The EAA is
currently working with FAA on this program, and hopefully they are
debating such matters, plus other depressing implications.  Like
removing financial incentive to flunk you the first time, to collect
another $500 the second!
