Richard, In Germany we obliged to switch on our Mode S : Over 5000 ft In a TMZ In a CTR Otherwise no transponder necessary. In Holland I believe it is compulsory above 1200 ft but must be switched off under the Amsterdam TMA. So you have to have it but cannot use it! No Idea for the rest of Europe.
